of virginia spoke candidly today about what he described as a sub-par 911 call routing system run by verizon. now he is the one making the call to the fcc and he wants some change. >> i guess i would give it a d. >> reporter: virginia congressman gerry connolly is slamming verizon wireless. the company is contracted to route 911 calls throughout most of the washington area. according to him they have fallen short. >> the whole purpose of having 911 is when you need it, it works. >> reporter: he cites recent weather events that have knocked out the system as examples of where they've failed. during the 2010-11 winter several storms like snowmageddon interrupted service. more recently this summers deer re summers derecho did the same

thing. now he and others are behind a push to verizon to improve their service or face scrutiny. >> if verizon can't be counted on to do that voluntarily then we need the fcc to step in and promulgate new regulations and to make sure they're enforced. >> reporter: verizon fired back. they said they've learned to improve themselves. a spokesman wrote, verizon's network performed well during and after sandy as backup power seamlessly kicked in including arlington. but that most recent performance stle assurance for an uneasy congressman who believes lives are in jeopardy. >> this is all about protecting the public. >> the s.e.c. has been looking into verizon's performance. a spokesman said what happened to 911 service was unacceptable. we will soon release the findings of our inquiry into what occurred along with the next steps.

we will keep a close eye on this and let you know what happens. tweet me at ken at wusa9.com. president obama and speaker john boehner talk on the phone tonight for the first time in a week but they ended their conversation with no break in the deadlock over how to avoid the rapidly approaching fiscal cliff. the president's secretary said the administration is absolutely 3r-7d to go over the cliff if republicans don't agree to tax rate increases. speaker boehner says it is now up to the president to spell out a plan that will pass. the president told business leaders that ending fights over extending the country's debt ceiling have to be a part of this deal. now part of our deal here at 9news is having gary nurenberg follow these fiscal cliff developments. he is here with tonight's wrap- up. >> reporter: an knit tax you are right, the president and the speaker got on the phone but as if to signal the lack of progress the house got out of town. the republican controlled house left town wednesday saying it has nothing to do.

>> we need a response from the white house. we can't sit here and negotiate with ourselves. >> reporter: the president's treasury secretary said there's no room for negotiation on its demand for tax rate hikes for top income earners. >> is the administration prepared to go over the fiscal cliff? >> absolutely. there's no prospect for an agreement that doesn't involve those rates going up on the top 2% of the wealthiest members. >> reporter: republicans insist they can get the revenue without increasing tax rates. >> the revenues we're putting on the table are going to come from, guess who, the rich. >> reporter: but the president says that won't work. >> it is not possible for us to raise the amount of revenue that's required for a balanced package if all you are relying on is closing deductions and loopholes. >> reporter: if there's no deal cbs reports families making 20 to 40,000 next year will have taxes go up $100.

are document gang members and they believe the shooting is gang related. the car used in the shooting has been recovered. no suspects. a gun was found inside a student's locker in fairfax today. a letter about it was sent home to parents. it stated the suspects involved have been questioned and discipline near action will be taken. fresh testimony at the pretrial hearing for bradley manning, the private charged with giving u.s. government secrets to wikileaks. at issue whether the nine months manning spent in the brig amounted to illegal punishment, and if it did, should the case be dismissed because of it? today the top administrator says brig officials used improper procedures to recommend that manning be held in maximum custody. tonight we've got an update on the tragic death of a new york city man whose final moments were captured in that picture. tonight a 30-year-old homeless man faces second-degree charges

of murder. davis is accused of shoving that victim following a confrontation. davis has a long record in new york and pennsylvania. police say the victim tried to climb a few feet to safety but got trapped between the train and the platform's edge. what was planned as a birthday party for jazz great dave brubeck is now becoming a memorial tribute. brubeck died today in connecticut one day shy of his 92nd birthday. gotta know that one. take five from the 1959 album time-out. it was the first jazz album to sell a million copies. grammy winner dave brubeck been at the age of 91. a memorial service was held today for kansas city chiefs linebacker jovan belcher. belcher shot his girlfriend saturday morning. the couple add three-month-old daughter together. then he drove to arrowhead stadium where he shot and

killed himself. we've posted the 911 calls that belcher's mom made begging belcher to stay alive. today a fairfax county judge made it clear just because you post an announcement review doesn't mean you can say anything you want. as bruce leshan tells us a woman may have to pay hundreds of thousands in damages for the nasty review she posted on-line about a local contractor. >> to finally be winning on principles and knowing that good people do prevail, it's very, very happy. >> reporter: contractor christopher dietz crowing after winning a preliminary injunction against a former customer would wrote a series of scaight on-line reviews. >> what she put up there were pure lies and stated as fact, and so that damage can never be undone but we can certainly stop any future damage. >> reporter: jane perez said

she never imagined her reviews on yelp and angie's lis would it land her in court facing potentially hundreds of thousands of dollars in damages for defamation. she had hired dietz to install a toilet, refinish floors and fix some light swipes. but when things went south she wrote that dietz had damaged her home and hinted that he had stolen her jewelry. the judge ordered her to take down any allegations of thievery and to stop claiming she had won another lawsuit against dates on the merits. her lawyer says there is a warning here for all of us. >> be very careful have. it appears, at least in virginia, you have to watch very carefully what you say and what you opine. >> reporter: but the judge did not order perez to change a bunch of other nasty things in her review. >> that he charged for work that had not been done, and that the workmanship was very

a new study out of the u.k. could change the way women everywhere are treated for breast cancer. british researchers have found
